Driving bans: suspension or reduction of the penalty

The offence category and your driving record over the previous five years affect what can be sought when a ban is at stake. You can document a need to drive for work so that it can be assessed in your case.

What to check in your case

For a serious offence, Article 141 permits suspension of a ban if the fine has been paid and the other legal conditions are met. For a very serious offence, Article 140 allows the lower and upper limits to be halved if payment, driving history and the circumstances permit. The request can accompany the defence within 15 working days of service. An employer’s letter should describe your duties, journeys and available alternatives.

Documents for your defence
