How to challenge a Portuguese ASAE fine

Check whether the notice from Portugal’s food and economic safety authority, ASAE, cites the Economic Offences Regime (RJCE). Where it applies, Article 58 allows 20 days, counted continuously from service of the notice, to file a written defence.

What to check in your case

Identify the product, establishment and duty said to have been breached. You may ask to be heard, submit documents and name up to five witnesses. If a penalty has already been imposed, Article 69 allows 30 days from service to bring a court appeal. Address the written appeal, including grounds and conclusions, to the competent court and file it with the authority that imposed the penalty. Distinguish subsequent corrective steps from the records showing conditions on inspection day.
