How to challenge a traffic fine in Portugal

The notice identifies the alleged offence, the authority handling the case and how to reply. Under Article 175 of the Portuguese Highway Code, you have 15 working days from service to submit your defence.

What to check in your case

In your written defence in Portuguese, give the case number, the facts you dispute and the outcome you seek. Explain what each photograph, document or witness can establish. You can name up to three witnesses. If the letter already contains a decision imposing a penalty, consider a court appeal. Keep proof of filing with the authority named in the notice.

Documents for your defence

Full notice or decision, front and back, and evidence of the date of service.

  • Full offence report and notice, including the instructions on the reverse
  • Envelope, postal acknowledgement or electronic proof of service
