How to respond to an ACT labour inspection notice

In ordinary labour offence proceedings, service of the report generally opens a 15-day period to reply in writing in Portuguese. Time under Law 107/2009 runs continuously, including during court vacations.

What to check in your case

First establish whether this is a notice inviting a defence, a request for documents or a final penalty decision. The defence may name up to two witnesses per offence, capped at five in total for three or more offences subject to a single fine. A penalty decision may be appealed within 20 days of service by addressing the labour court and filing with the authority that decided the case. Match each allegation to the records for the workplace, employee and dates inspected.

Documents for your defence
