Road fines in Portugal: deposit or voluntary payment

A deposit secures payment while the alleged offence is disputed. Voluntary payment settles the fine at the statutory minimum under the applicable conditions. A driving ban may still need to be decided.

What to check in your case

For a notice served during a roadside check, Article 173 provides for a deposit immediately or within 48 hours. With postal service you may lodge a deposit within 48 hours of service. Without a timely defence, the deposit becomes payment. It is refunded if no penalty is imposed. Check what the receipt records, particularly if the notice mentions licence points or an additional penalty.

Documents for your defence
