When does a Portuguese traffic fine become time-barred?

The basic limitation period for Portuguese road traffic offence proceedings is two years from the offence. To establish whether it has expired, check the steps taken in the case and any periods during which time was suspended.

What to check in your case

Valid service or certain evidential steps may interrupt the period. Article 28(3) of the general legislation also sets an overall limit equal to the ordinary period plus half, excluding periods of suspension. Enforcement of a fine or additional penalty already imposed has its own basic two-year period, beginning when the administrative decision or judgment becomes final. A dated record of each procedural step allows both calculations to be checked.
