Using a mobile phone while driving

Article 84 provides for a fine of €250 to €1,250 for prohibited use of a device while the vehicle is moving. The offence can lead to disqualification and the loss of three points once the decision is final.

What to check in your case

Explain where the device was and the action described by the officer. A call record alone cannot show how the device was handled. Specific conditions apply to hands-free systems and a single earpiece.

Documents for your defence

Full notice or decision, front and back, and evidence of the date of service.

  • Details of the device and any hands-free system used
  • Positions of the vehicle and the observer
